General Terms and Conditions

for the Rental of Holiday Accommodation

The following General Terms and Conditions apply to the use of the above-mentioned holiday accommodation:

Scope

These General Terms and Conditions apply to the rental of the holiday accommodation for lodging purposes, as well as to all additional services provided to the guest by the landlady.

Booking

The booking of the holiday accommodation becomes binding upon receipt of the booking confirmation, which is sent to the guest following the online booking. Upon receipt of the booking confirmation, the booking is legally binding.

By making the booking, the present General Terms and Conditions as well as the house rules, which were made available to the guest in advance, are accepted.

Arrival, Departure and Minimum Stay

Arrival is possible from 3:00 pm on the day of arrival. Departure must take place by 10:00 am on the day of departure. Other arrival and departure times may be arranged by prior agreement.

The minimum stay is 2 days; during peak season it may be up to 7 days. Arrival is possible on any day.

At the end of the rental period, the guest must vacate the property, leave it in a clean and tidy condition (swept clean), and hand over the keys to the landlady.

Stay

The holiday accommodation, including its inventory and the facilities belonging to the property, must be treated with care by the guest. During the rental period, the guest is responsible for cleaning the accommodation. The guest must also ensure that windows are closed, lights switched off, and radiators turned down when leaving the apartment.

Use of the holiday accommodation is limited to the guests specified at the time of booking. If more persons than agreed use the accommodation, a separate fee of EUR 15 per person shall be payable. Subletting or allowing third parties to use the accommodation is not permitted.

During the stay, the house rules provided to the guest shall apply. In the event of violations of the General Terms and Conditions or the house rules, the landlady is entitled to terminate the rental agreement immediately and without notice. There shall be no legal entitlement to a proportional refund or compensation.

Rental Price and Payment Terms

The rental price includes all ancillary costs such as statutory VAT, bed linen, towels, Wi-Fi internet access, and all utility costs (electricity, water, heating), coffee, tea, spices, cleaning products, shampoo and shower gel, and toilet paper. The final cleaning of the holiday home is included in the rental price.

For accompanying pets (maximum 2), a one-off cleaning fee of EUR 30 per pet per stay will be charged.

The guest is obliged to pay the prices applicable to the rental of the holiday accommodation and any additional services used. Upon payment of a deposit of 30% of the rental price by bank transfer, the rental agreement becomes binding and the rental conditions are accepted. The remaining 70% of the rental price is due 7 days before arrival.

If less than 14 days lie between receipt of the invoice and the start of the rental period, the full amount is payable immediately.

If the tenant fails to pay the deposit or the remaining balance by the agreed date, they shall be in default without further notice. In this case, the landlady is entitled to terminate the contract without notice and to re-let the property.

Cancellation and Early Termination of Stay

If the guest cancels the rental agreement before the start of the rental period without naming a replacement tenant who takes over the rental under the same conditions, the following proportional rental payments shall be payable as compensation, provided that re-letting is not possible. The landlady will nevertheless endeavour to re-let the property.

In the event of cancellation, the guest is obliged to pay part of the agreed price as compensation. The amount of compensation is as follows:

  • 100% of the deposit paid is refundable if cancelled 28 days or more before arrival.

  • 70% of the deposit paid is refundable if cancelled 7 days or more before arrival.

  • 0% refund for later cancellations.

If the guest terminates the stay prematurely, they remain obliged to pay the full rental price. Any expenses saved or income from alternative letting shall be taken into account.

If arrival is legally prohibited and therefore impossible for the booked period due to a travel ban imposed by the Saxon State Government, no cancellation fees shall be charged.

The landlady may cancel the booked service without stating reasons up to 7 days before arrival. Any payments already made will be refunded in full. A later cancellation is also permitted in cases of force majeure or other unforeseeable circumstances making the stay impossible. In such cases, liability is limited to the refund of the rental price. In the event of justified cancellation, the guest shall have no claim for damages. Liability for travel and accommodation costs is excluded.

Liability and Obligations of the Guest and the Landlady

The landlady shall be liable within the scope of the duty of care for the proper provision of the rental property. Liability for possible failures or disruptions in water or electricity supply, as well as events and consequences due to force majeure, is excluded. The landlady shall also not be liable for loss of or damage to personal belongings or theft within the house or on the property.

The rental property, including furniture and other items contained therein, must be treated with care. The guest must ensure that accompanying persons and/or visitors also act with due care. The guest shall be liable for damages caused by themselves or accompanying persons through wilful misconduct or gross negligence. Any defects existing at the time of taking over the rental property or arising during the rental period must be reported to the landlady without delay.

Keeping animals is permitted only with prior agreement of the landlady. Pets must sleep in the baskets brought with them (not in beds or on upholstered furniture) and must be house-trained. Otherwise, the landlady reserves the right to charge a final cleaning fee of EUR 300. By bringing pets into the holiday home, the guest automatically accepts these conditions as well as the additional cleaning fee of EUR 30 per stay and per pet (maximum 2).

Strict liability of the landlady pursuant to Section 536a (1) of the German Civil Code (BGB) for material defects existing at the time of conclusion of the rental agreement is excluded. The landlady shall only be liable for material defects existing at the time of conclusion of the contract or occurring during the rental period in cases of fault.

Arrival and departure are at the guest’s own responsibility and risk. In the event of loss of the keys to the holiday accommodation, a fee of EUR 50 shall be charged.

Miscellaneous

Amendments and supplements to these General Terms and Conditions must be made in writing. This also applies to any amendment of this written form requirement. No verbal agreements have been made.

If and insofar as any provision of this contract violates mandatory statutory provisions, the corresponding statutory regulation shall apply in its place.

German law shall apply.

The place of jurisdiction shall be the location of the holiday home.
